TEXTING AND MOBILE MESSAGING POLICY

PURPOSE

This Policy establishes standards governing the Endowment Fund of the Phi Kappa Psi Fraternity’s (d/b/a Phi Kappa Psi Foundation; Phi Psi Foundation) (the “Foundation”) use of text messages and other mobile messaging technologies (collectively, “SMS”, “texting”, “iMessaging” or “Mobile Messaging”) to communicate with constituents including donors, volunteers, members, program participants, parents/guardians (where applicable), and other stakeholders. The Policy is intended to ensure transparency, consent, privacy, legal compliance, and responsible stewardship of personal information. 

SCOPE

This Policy applies to all Foundation departments, affiliated entities, officers, employees, contractors, and volunteers who initiate, manage, or oversee Mobile Messaging on behalf of the Foundation. 

GUIDING PRINCIPLES

The Foundation’s Mobile Messaging practices shall: 

  • Respect individual privacy and preferences; 
  • Comply with applicable federal, state, and local laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM principles as applicable to SMS; 
  • Be transparent about message purpose, frequency, and data use; 
  • Use Mobile Messaging to support the Foundation’s charitable and educational mission and relationship-building efforts; and 
  • Maintain appropriate oversight, data security, and accountability. 

PERMITTED USES

Mobile Messaging may be used for purposes including, but not limited to: 

  • Event-related communications (e.g., reminders, logistics, schedule updates); 
  • Program and participant communications; 
  • Donor stewardship, acknowledgments, and mission-related updates; 
  • Volunteer coordination; 
  • Time-sensitive or operational notices; and 
  • Fundraising appeals consistent with the Foundation’s development practices. 

CONSENT AND OPT-IN

1. Affirmative Consent by Providing a Mobile Number
By voluntarily providing a mobile phone number to the Foundation, an individual affirmatively consents and opts in to participate in the Foundation’s Mobile Messaging program (the “Program”). Such consent authorizes the Foundation to send recurring mobile messages to the mobile phone number provided, even if that number is registered on any state or federal “Do Not Call” list.

2. Method of Opt-In
Consent may be provided through a variety of means, including but not limited to online forms, event or program registrations, written agreements, donations, membership records, text-to-join keywords, or other interactions where a mobile phone number is knowingly and voluntarily supplied.

3. Scope of Consent
Messages may include informational, transactional, programmatic, stewardship, fundraising, and operational communications related to the Foundation’s mission. Message frequency may vary based on engagement and activity.

4. Required Disclosures
At the point of collection, or as part of the initial message, individuals will be informed that: 

  • Message and data rates may apply;
  • Consent to receive mobile messages is not a condition of any purchase or donation; and
  • Individuals may opt out of receiving messages at any time. 

OPT-OUT AND HELP

Individuals may opt out of Mobile Messaging at any time by replying STOP (or an equivalent keyword). Upon opting out, individuals will receive a confirmation message and will no longer receive messages unless they re-opt in. Individuals may request help or additional information by replying HELP or contacting the Foundation directly. 

MESSAGE CONTENT AND FREQUENCY

Message frequency shall be reasonable and aligned with the stated purpose. Content shall be mission-related, respectful, and appropriate to the audience. The Foundation shall not send messages that are misleading, coercive, or inconsistent with its values. 

DATA COLLECTION AND USE

The Foundation may collect mobile phone numbers and related metadata solely for communication purposes aligned with this Policy. Mobile numbers shall not be sold, rented, or shared with third parties for their independent marketing purposes. The Foundation may share information with trusted service providers solely to facilitate messaging services, subject to confidentiality and data protection obligations. 

DATA SECURITY AND RETENTION

The Foundation shall take reasonable administrative, technical, and physical safeguards to protect mobile data from unauthorized access, disclosure, or misuse. Mobile Messaging data shall be retained only as long as necessary to fulfill communication, legal, or operational needs, consistent with the Foundation’s record retention policies. 

THIRD-PARTY PLATFORMS

Mobile Messaging may be delivered through third-party platforms or vendors. Vendors must demonstrate compliance with applicable privacy and security standards and agree to use information only as directed by the Foundation. The Foundation is not responsible for delays or failures in message delivery caused by carriers or third-party providers. 

PRIVACY STATEMENT INTEGRATION

Mobile Messaging practices are governed by and incorporated into the Foundation’s broader Privacy Policy. In the event of a conflict, the more protective provision regarding personal data shall apply. 

POLICY REVIEW AND UPDATES

This Policy shall be reviewed periodically and updated as necessary to reflect changes in law, technology, or Foundation practices. Material changes will be communicated through appropriate channels.
